Applicable Regulations

Section 2 of Article 22 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter, LSSI-CE), establishes the following:

1. Service providers may use data storage and retrieval devices on recipients’ terminal equipment, provided that the recipients have given their consent after being provided with clear and complete information about their use, in particular, about the purposes of data processing, in accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data.

When technically possible and effective, the recipient’s consent to accept data processing may be facilitated through the use of appropriate browser settings or other applications, provided that the recipient must configure them during installation or update through an express action to that effect.

The foregoing shall not prevent any technical storage or access for the sole purpose of carrying out the transmission of a communication over an electronic communications network, or, to the extent strictly necessary, for the provision of an information society service expressly requested by the recipient.

According to the “Guide on the Use of Cookies” published by the Spanish Data Protection Agency (hereinafter, AEPD) in 2013, the LSSI-CE applies to any type of file or device downloaded to a user’s terminal equipment for the purpose of storing data that may be updated and retrieved by the entity responsible for its installation. The cookie is one such widely used device; therefore, we will generically refer to these devices as cookies.

Cookies used for any of the following purposes are exempt from compliance with the obligations established in Article 22.2 of the LSSI-CE:

Types of Cookies by Purpose

A cookie is a file downloaded to your computer when you access certain web pages. Cookies allow a website, among other things, to store and retrieve information about a user’s browsing habits or their equipment and, depending on the information they contain and how you use your equipment, they can be used to recognize the user.

As stated in the AEPD “Guide on the Use of Cookies”, according to the purpose for which data obtained through cookies is processed, we can distinguish between:

  • Technical cookies: These allow the user to navigate through a website, platform or application and use the different options or services available therein, such as controlling traffic and data communication, identifying the session, accessing restricted access areas, remembering the items that make up an order, completing the purchase process, submitting a registration or event participation request, using security features during browsing, storing content for video or audio distribution, or sharing content through social networks.
  • Personalization cookies: These allow the user to access the service with certain predefined general characteristics based on criteria on the user’s terminal, such as language, browser type, or regional configuration.
  • Analytics cookies: These allow the responsible party to monitor and analyze the behavior of users on the websites to which they are linked. Information collected through this type of cookie is used to measure website activity and to create user browsing profiles in order to introduce improvements based on usage data analysis.
  • Advertising cookies: These allow the most efficient management of advertising spaces that the publisher may have included on a website, application, or platform from which they provide the requested service, based on criteria such as edited content or ad display frequency.
  • Behavioral advertising cookies: These allow the most efficient management of advertising spaces included on a website. These cookies store user behavior information obtained through continuous observation of browsing habits, enabling the development of a specific profile to display advertising based on it.

In compliance with Article 5 of Organic Law 15/1999, of December 13, on the Protection of Personal Data (hereinafter, LOPD), we expressly, precisely, and unequivocally inform you that the information obtained through cookies installed on your computer will be used for statistical purposes.

Consent Principle

Consent for the installation of cookies will be understood as granted by checking the box for acceptance of the “Cookie Policy” provided on our website.

In cases where the user does not expressly state whether they accept or reject the installation of cookies, but continues using the website or application, they will be deemed to have given consent. Our entity expressly informs you of the possibility of blocking or deleting cookies installed on your device through your browser settings.

Optional Nature of Cookie Installation
